Basics of Personal Data Processing
Personal data will be processed for the purpose of responding to your inquiry (providing the requested information about the product, including its availability) and conducting further email correspondence in this regard (legal basis: Article 6(1)(f) of the GDPR).
- to contact you by phone or email based on your consent (legal basis: Article 6(1)(a) of the GDPR);
- to enter into a contract for the provision of our services based on your interest in our offer (legal basis: Article 6(1)(b) of the GDPR);
- for the purpose of performing the contract you have entered into with us for the provision of our services (legal basis: Article 6(1)(b) of the GDPR);
- for analytical purposes (e.g., to optimize our products based on your feedback; optimizing service processes based on sales and after-sales service, including complaints), which is our legitimate interest (legal basis under Article 6(1)(f) of the GDPR);
- for archival (evidential) purposes to preserve information in the event of a legal need to prove facts, which is our legitimate interest (based on Article 6(1)(f) of the GDPR);
- for the purpose of potentially establishing, investigating, or defending against claims, which is our legitimate interest (based on Article 6(1)(f) of the GDPR);
- to survey customer satisfaction and assess the quality of our service, which is our legitimate interest (legal basis: Article 6(1)(f) of the GDPR);
Information on the Voluntary Nature of Data Provision
Providing your personal data is a condition for entering into a contract for the provision of our services and for the performance of the contract. If you do not provide your personal data, we may refuse to enter into the contract.
Privacy Policy
This Policy is a personal data protection policy within the meaning of the GDPR—Regulation (EU) (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, p. 1) at SANIWELL Sp. z o.o., with its registered office in Kraków (hereinafter: the Company).
- The data will not be disclosed to anyone unless it is necessary to perform a contract to which the Company is a party or unless required by law.
- You have the right to access your data, including the right to obtain a copy of your data, the right to data portability, the right to rectification and erasure of your data, the right to restrict processing, and the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or similarly significantly affects you (see more at www.uodo.gov.pl).
- You also have the right to file a complaint with the supervisory authority (the President of the Personal Data Protection Office).
- If your personal data is processed based on your consent, you may withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of the processing carried out prior to the withdrawal of consent. If you withdraw your consent, the Company will assess whether it still has a legal basis for processing your data.
- If the specified marketing consents are granted, personal data will be processed until any of them is withdrawn. Further processing of data in such a case will be permitted to defend against claims (e.g., by demonstrating that the right to withdraw consent has been exercised) and only to the extent necessary for that purpose.
- For purposes other than — other than the aforementioned marketing purposes — personal data will be processed for the duration of the statute of limitations for potential claims related to the correspondence, in particular those arising from the process of concluding and performing a contract entered into by the Company or the period of public-law obligations.
- Providing data is voluntary but not necessary for the fulfillment of the aforementioned purposes. Whenever personal data is processed pursuant to Article 6(1)(f) of the GDPR (see above)—that is, in the case of the Company’s so-called legitimate interest—you may object at any time, on grounds relating to your particular situation, to the processing of your personal data. Once an objection has been raised, the Company will no longer be able to process personal data unless it demonstrates the existence of valid, legally justified grounds for processing that override the interests, rights, and freedoms of the data subject, or grounds for establish, exercise, or defend legal claims.
